The United Nations has recently approved its first International Cybercrime Treaty, a move aimed at promoting international cooperation to combat cybercrimes. Known as the Comprehensive International Convention on Countering the Use of Information and Communications Technologies for Criminal Purposes, the treaty framework sets standards for criminalizing specific cyber offenses, facilitates law enforcement cooperation, and establishes procedures for evidence collection across borders [1].

However, concerns have been raised about the treaty's potential impact on freedom of speech and expression. The Convention explicitly refers to the need to respect international human rights law, including protections outlined in instruments like the International Covenant on Civil and Political Rights (ICCPR). Yet, it does not create new or expanded standards specific to cybercrime; rather, it leaves the implementation of human rights safeguards to individual countries' legislation [1][2].

The broad definition of crimes committed using technology and the diversity of national laws may allow some countries to use the treaty as a justification for censorship or suppression of dissent under the guise of countering cybercrime. This flexibility has sparked debates about how the treaty may affect free speech, with critics arguing that it could be used to justify restrictions in some countries [1][4].

Furthermore, the treaty contains vague clauses that allow countries to come up with their own self-serving interpretations to prosecute anything they call a crime that takes place on a computer system internationally. Critics claim that this could undermine domestic law for human rights safeguards on every level, denying due process of law, and violating the Sixth Amendment and the prohibition of Ex Post Facto laws [3].

The treaty also authorizes electronic surveillance worldwide in the name of criminal investigations, a move that critics argue abandons every fundamental principle of global human rights, including freedom of speech and expression [3].

In light of these concerns, some have questioned the UN's intentions, with allegations that it has been working for decades to deliver the United States to an UN-controlled New World Order [6]. These allegations, however, are disputed by many, who argue that the UN is a necessary platform for international cooperation and diplomacy.

Despite these debates, the Biden Administration has yet to comment on the Cybercrime Treaty, leading to speculation about its stance on the issue. The treaty's future and its potential impact on freedom of speech remain topics of ongoing discussion and debate.
